Justice Department Launches Antitrust Probe Into ABC, CBS, CNN, Fox News and NBC Over Coordinated Suspension of White House TV Pool Coverage After Trump Administration Barred CNN and Other Outlets

The U.S. Department of Justice has launched an antitrust investigation into five major television networks after they jointly suspended coverage of President Donald Trump through the White House television press pool, escalating an already tense confrontation between the administration and the news media.

The investigation involves ABC, CBS, CNN, Fox News and NBC, which temporarily stopped providing pooled television coverage after the Trump administration barred CNN, MS NOW and Politico from White House access in September. The Justice Department announced the inquiry on Saturday, October 10, saying it would examine whether the networks’ collective action violated federal antitrust law.

Emily Covington, a Justice Department spokesperson, said that coordinated boycotts among competing businesses can violate the Sherman Antitrust Act. She stressed that the department was investigating whether the networks had breached the law, rather than announcing that any violation had already been established. The department has reportedly issued civil investigative demands as part of its inquiry.

The dispute began on September 19, when the Trump administration barred CNN, MS NOW and Politico from the White House, accusing the outlets of unfavorable or inaccurate reporting. CNN was scheduled to handle television pool coverage of the president’s activities, including his travel to New York, but the administration prevented the network from carrying out its assignment.

In response, the five networks that make up the television pool announced that they would no longer provide pooled coverage of the president’s events. Their joint statement emphasized the public’s interest in receiving accurate, independent information about the government and argued that administrations should not restrict news organizations because they disagree with their reporting.

The White House television pool is a long-established system in which broadcasters take turns covering presidential events and distribute footage and information to other news organizations. The arrangement allows journalists to report on the president when space or security restrictions make it impossible for every outlet to send its own crew.

Because the pool’s footage is shared widely, the temporary suspension affected not only the five participating networks but also other news organizations that rely on the pool for access to presidential events. Individual networks nevertheless continued covering White House events that remained open to the press.

CNN, MS NOW and Politico challenged their exclusion in federal court, arguing that the administration had violated their constitutional rights. Their lawsuit alleged that the restrictions infringed on press freedom and were imposed in retaliation for critical coverage of Trump.

U.S. District Judge Timothy Kelly ordered the administration to restore the outlets’ access temporarily on September 24. The order was subsequently extended while the court considered whether to issue a preliminary injunction. Television pool coverage has since resumed.

The Justice Department’s investigation raises a separate legal question from the media organizations’ constitutional challenge. Antitrust law generally addresses conduct that improperly restrains competition, including certain agreements between competing businesses. Investigators will need to determine whether the networks’ collective decision amounted to unlawful coordination or whether it was a legitimate editorial response to the administration’s restrictions.

The inquiry has also prompted concerns about the potential effect on press freedom. Jose Zamora, the Americas regional director for the Committee to Protect Journalists, criticized the investigation, warning that antitrust proceedings should not be used to intimidate news organizations defending their access to government officials.

The networks had not all publicly responded to the investigation when it was announced. ABC News said it had not received formal notification but expected to, while representatives for some of the other outlets declined to comment. The White House had not immediately responded to requests for comment, according to NBC News.

The case places two important principles at the center of a growing dispute: the government’s ability to enforce competition laws and the press’s ability to make independent editorial decisions. The Justice Department’s inquiry does not itself establish wrongdoing, and its outcome will depend on the evidence gathered and the legal standards applied.

For now, the investigation marks another escalation in the Trump administration’s conflict with major news organizations. As the legal proceedings continue, the dispute could have implications not only for the five networks but also for the broader relationship between the White House and the journalists responsible for informing the public about presidential activities.
